TERMS & CONDITIONS
By submitting the Booking Form I declare that I have read and accept the following Terms & Conditions.
1. CONTRACT
Anna Belle Group Ltd, hereafter referred to as the Company, Company No. 2009/C237, whose registered office is at Rodney Bay, P.O. Box 2559 RB, Gros Islet, St.Lucia, in the West Indies. These booking conditions govern all bookings with Anna Belle Group Ltd DBA www.TropicalHolidayShop.com
The Company sells customized holiday arrangements which do not include air tickets and which the Company makes as a booking agent, your contact being the provider(s) (e.g. the tour operator or hotel) concerned, a copy of whose conditions are available on request.
Any booking made or order placed by you, whether through the Company’s website or otherwise, shall be deemed an offer by you to purchase the holiday arrangement subject to these booking conditions. No contract between you and the Company shall come into existence until the Company accepts full payment and issues a confirmation invoice. All contracts with the Company and all matters arising from them are subject to St. Lucian law and to the exclusive jurisdiction of the courts of St. Lucia. The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the company are only available to persons who are at least 18 years old. By submitting a booking you warrant and confirm to us that you comply with those arrangements.
2. FINANCIAL PROTECTION
Pre-payments to the Company are non-refundable. We highly recommend that you protect your investment with travel insurance for your trip, and to cover any activities taken.
3. PAYMENTS
Deposit - No booking will be confirmed unless the required deposit has been received by the Company. Deposits are non-refundable. Bookings are not guaranteed until full payment has been received.
Balance - You must pay the balance 45 days prior to the first day of the booked holiday arrangement.
Telephone Bookings - Please note that for telephone bookings full payment may be required immediately i.e. before you receive confirmation. If this applies you will be advised when the booking is made.
Extra Booking Charge - Clients will be advised about extra “booking charges” at time of booking.
4. CANCELLATION POLICY
All changes made to the original reservation must be notified to us in writing (e-mail or fax) by the person who made the original booking.
Cancellation before Balance Payment - If only a deposit has been paid, the person who made the booking may in writing present The Company with a replacement. Upon receipt of the deposit from the replacing individual a refund minus any charges that may apply is made to the person who made the original booking. The replacing individual is required to pay the remaining balance 45 days prior to the first day of the booked holiday arrangement.
Cancellation after Balance Payment - If full payment has been made, the person who made the booking may in writing present The Company with a replacement. Only upon receipt of full payment from the replacing individual a refund minus any charges that may apply is made to the person who made the original booking. Name changes may occur up to 5 days prior to the first day of the booked holiday arrangement.
Note: Only one name change per reservation. The Company is not liable to finding a replacement for cancellations.
5. CANCELLATION AND CHANGES BY THE COMPANY
Minor Changes - It is unlikely that we will have to make any changes to your holiday arrangements however if necessary, the Company reserves the right to make minor changes to the program schedule. Most of these changes will be minor and we will advise you of them at the earliest possible date.
Major Changes - If we make a major change to your holiday, we will inform you as soon as reasonably possible. We also reserve the right in any circumstances to cancel your holiday arrangements. For example, if the minimum number of clients required for a particular holiday arrangement is not reached, we may have to cancel it. However, we will not cancel your holiday arrangements less than 6 weeks before your departure date, except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can choose to accept a change of arrangements, have a refund of all monies paid, or upon availability accept an offer of alternative travel arrangements of comparable standard. We will refund any price difference if the alternative is of a lower value.
Our limit of liability will be a full refund of any monies that have been paid to the Company.
6. OUR LIABILITY TO YOU
The Company neither controls, nor operates, nor is responsible for the actions of independent contractors such as airlines, ground transportation, tour operators, instructors, animation & tour guide personnel, or other service providers associated with the bookings of your holiday arrangement. The company denies any responsibility or liability for late arrival of your flight or for any illness, injury, delay, loss or damage to property or health or other irregularities resulting there from. The Company shall not be held liable or responsible for any expenses including but not limiting to lodging, meals and transportation incurred by delays or force majeure outside of our control.
Unless otherwise indicated the packaged holiday arrangements include accommodation, meals at a set time and location, as well as excursions and activities as provided on the itinerary. If necessary, the Company reserves the right to make changes to the program schedule. No part of the paid price is refundable due to non-participation in any part of the group itinerary.
Alcoholic beverages are not included in the standard holiday arrangements unless part of an all inclusive offer. Upon request our holiday sales team can arrange additional villa, car rental, boat charter, and excursion or activity bookings. Additional bookings are not part of the holiday arrangement and need to be paid separately. It is to be noted that in some cases a security deposit is required in order to process bookings for villa accommodation, or boat charters. By acceptance of these terms and conditions you agree your credit card will be debited locally for this facility.
7. BEHAVIOUR
It is your responsibility to ensure that you and the members of your party do not behave in a way which causes offence or danger to others or which risks damage to property belonging to others. In such circumstances all suppliers (e.g. hotel managers, tour operators) and the Company have the right to terminate arrangements made on your behalf, in which case the Company’s responsibility to you ceases immediately and there can be no refunds, no payment of compensation and no reimbursement of any cost or expenses you may incur as a result. Further, you will be liable to reimburse the Company for any expenses whatsoever it incurs as a result of your behaviour.
8. SPECIAL REQUESTS AND MEDICAL PROBLEMS
If you have any special requests, please advise us at time of booking. Although we will endeavour to pass any such requests on to the relevant supplier, we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part. If you have any medical problem or disability which may affect your booked arrangements, you must advise us in writing at the time of booking giving full details. If we feel unable to properly accommodate your particular needs, we must reserve the right to decline/cancel your booking.
9. IF YOU HAVE A COMPLAINT
If you have a problem during your holiday, please use the office contact numbers provided by the Company to inform the Company’s on island representatives who will endeavour to put things right. If your complaint cannot be resolved locally we strongly recommended that you communicate any complaint to the supplier of the services in question as well as to your travel insurance without delay. Any suggestions from the client will be gladly accepted in order to improve the level of services and accommodation provided.
In the case of emergencies please feel free to use our 24/7 emergency hotline that will be provided by the Company upon arrival.
11. PRICING POLICY
All fares and other information are subject to availability. Until the confirmation invoice has been issued the published prices (i.e. website & other marketing material) may fluctuate due to an increase in surcharges. The Company reserves itself the right to amend published prices due to cost increases levied by suppliers, government action, increase in transportation costs, changes in dues and taxes (including VAT), or to reflect fluctuations in exchange rates. All prices published by the Company are in USD. Current exchange rates will apply.
12. TRAVEL INSURANCE
We strongly recommend that you take out travel insurance for your whole journey.
13. DEFINITIONS
Force Majeure - includes war, threat of war, riot, civil disobedience or strife, industrial dispute, terrorist activity, natural or industrial disaster, fire, adverse
weather conditions, level of water in rivers, unavoidable technical problems with transport, or unavoidable event beyond the Company’s control.
